Welcome to Evermore (evermore.org). These Terms & Conditions (“Terms”) govern your access to and use of our website, services, and related content (collectively, the “Services”). By accessing, browsing, downloading, or otherwise using the Services, you confirm that you have read, understood, and agreed with these Terms. If you do not agree, please do not use our Services.

2. About Evermore

Evermore is a nonprofit dedicated to making the world a more livable place for all bereaved people. We connect lived experience with research to make lasting social change for all bereaved people.

Our work is grounded in five core values: Just (creating just systems for all), Respectful (recognizing and honoring our differences), Evidence-based (relying on the highest quality evidence), Innovation (driving innovation in bereavement care), and Trustworthy (serving as a trusted community partner and leader).

3. Permitted and Prohibited Uses

Permitted Uses:

  • Viewing and downloading content for personal, non-commercial use
  • Sharing content with proper attribution via social media and email
  • Accessing our support resources and signing up for our mailing list
  • Using our search and navigation functions to locate information

Prohibited Uses:

  • Scraping, crawling, or harvesting content without written permission
  • Reproducing, republishing, or distributing content for commercial purposes
  • Removing, obscuring, or altering copyright, trademark, or attribution notices
  • Using automated tools, bots, or scripts to access our Services
  • Uploading or transmitting viruses, malware, or harmful code
  • Attempting to bypass security measures or gain unauthorized access
  • Harassing, abusing, or defaming others through our Services

4. Intellectual Property Rights

All content on Evermore’s Services—including text, graphics, logos, images, audio, video, and software—is the exclusive property of Evermore or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. Evermore and its logo are registered trademarks with the U.S. Patent and Trademark Office. All rights are reserved. You may not use any trademark, logo, or service mark from our Services without our prior written consent. Unauthorized use may violate trademark law and other regulations.

5. Digital Millennium Copyright Act (DMCA) Notice

5.1 Copyright Infringement Claims

Evermore respects the intellectual property rights of others. The Digital Millennium Copyright Act of 1998 (“DMCA”) provides recourse for copyright owners who believe their work has been infringed. If you believe that material on our Services infringes your copyright, you may submit a written notice to our Designated Copyright Agent.

Any notice you submit must include the following information to be effective:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work that you claim has been infringed, or a representative list if multiple works are involved
  • Identification of the material that you claim to be infringing on our Services, with sufficient detail for Evermore to locate it
  • Your full name, address, phone number, and email address
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner or its agent
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner

Important: Misrepresenting that material infringes your copyrights may result in legal liability for damages, including costs and attorneys’ fees. Please consult with an attorney before submitting a DMCA notice if you are uncertain about whether content infringes your rights. Upon receipt of a valid DMCA notice, Evermore will remove or disable access to the allegedly infringing material and notify the person who posted or uploaded the content.

5.3 Counter-Notification

If your content has been removed from our Services as a result of a DMCA notice, and you believe that removal was made in error, you may submit a written counter-notification to our Designated Copyright Agent.

Your counter-notification must include:

  • Identification of the material that was removed and the location where it appeared before removal
  • A statement that you consent to the jurisdiction of the Federal District Court where your address is located, or if your address is outside the U.S., consent to jurisdiction in any court where Evermore is located
  • A statement that you will accept service of process from the person who filed the original DMCA notice
  • Your signature, along with a statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification

5.4 Repeat Infringers

In accordance with Section 512(i) of the DMCA, Evermore may, in its sole discretion and without liability, disable and/or terminate the accounts or access of users who are found to be repeat copyright infringers.

6. Third-Party Links and Content

Evermore may provide links to third-party websites and content as a convenience. We are not responsible for the accuracy, completeness, or legality of third-party websites, and do not endorse their content or practices. Your access to third-party sites is governed by their own terms of service and privacy policies. Please review those documents carefully before providing personal information or accessing content.

7. Privacy and Personal Information

Your use of our Services is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. Please review our Privacy Policy at evermore.org/privacy-policy.

10. Limitation of Liability

To the fullest extent permitted by law, Evermore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of or inability to use our Services, even if we have been advised of the possibility of such damages.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the federal and state courts located in the District of Columbia.

12. Modification of Terms

Evermore reserves the right to modify these Terms at any time. We will post updates on our website, and your continued use of our Services following such changes constitutes your acceptance of the modified Terms. Please review these Terms periodically for updates.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and such invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
